Criminal justice
Administrative
law violation (misdemeanour)
is
culpable (intended or careless) action or idle activity which infringe on the
public order, property, the rights and the freedoms of citizens, the set
procedure of management and which according to the law should bear
administrative responsibility.
Administrative
penalty
is a measure
of responsibility which is applied with the purpose of upbringing a person who
has committed administrative infringement of the law in the spirit of observing
the Ukraine’s laws, respect to the rules of cohabitation and warning against new
law violations by a wrong doer itself and other persons.
Criminal Code
of Ukraine
is the legal norms set by the highest body of legislative power which identifies
what public actions should be considered as criminal and what kind of punishment
should be used against the persons who committed them.
Crime
is identified as an action which infringes the
Criminal Law of Ukraine, its
political and economic systems, property, person, political, labour, ownership
and other rights and freedoms of citizens and socially dangerous actions which
encroach on law and order and other activities forbidden by the criminal law.
The number of
identified
crimes
are the officially identified socially dangerous actions which according to the
Criminal Code.
Intended crime
occurs when a person that committed it has been aware of the socially dangerous
nature of his actions or idling. A person should have foreseen the socially
dangerous after-effects or consciously assumed the manifestation of these
after-effects.
Severe crimes
are
intended crimes that have a heightened social danger.
Responsibilities of minors:
persons aged 16 or older can have criminal responsibilities if they
committed a crime. Persons who have committed a crime at the age of 14–16 are
also subject to criminal responsibilities for: murder, intentional infliction of
body injures that caused the worsening of health, rape, theft, robbery,
brigandage,
malicious or specially malicious hooliganism, intentional destruction or damage
to the property that led to the heavy after-effects and for intentional actions
which could cause a train crash.
Narcotics
are
medical preparations and substances (barbamil, codeine, morphine, omnopone,
phenamin, ephedrone, etc) and also plants or their parts that contain drug
substances (different brand of hemp, poppies or poppy straw, etc).
Psychotrophic substances
are some psychic substances that are
included into a List of drugs (DET, DMT, LSD, mescaline, alphitamin, amobarbital,
etc). Precursors are toxic substances (phenil-acetone, ephedrine,
calium-permanganat). From February, 1995 criminal punishment has been introduced
for activities related to illegal turnover of precursors.
Crime rate
– the number of registered crimes per 100 thsd. average annual present
population.
Conviction
rate
– the number
of convicted persons (by Court’s decisions that became legal) per 100 thsd.
average annual present population.
Fire
is uncontrolled burning outside special bonfire that spreads in time and space.
The State fire
supervision
refers to fire protection of communities and objects, coordination of activities
of ministries, other central bodies of executive power
dealing with improvements to fire protection that is secured by
Department
for Prevention
of Disasters and State Supervision
(Control) of the State
Service
of Ukraine of Emergencies.
